At its 173rd meeting on 13 December 2022, the Administrative Council of the European Patent Organisation decided to extend an invitation to accede to the European Patent Convention (EPC) to the Republic of Moldova. Before acceding to the EPC, the Republic of Moldova will need to enact national legislation to facilitate its implementation and application. Moldova is expected to become the 40th contracting state to the EPC.
As widely known by now, the start of the Sunrise Period has been postponed to March 1, 2023. The Unitary Patent Court Agreement (UPCA) will therefore enter into force on June 1, 2023.
However, the date for the start of transitional measures offered by the EPO remains unchanged despite the postponement of the start of the Sunrise Period.
Early requests for unitary effect and requests for deferral of the decision on grant can therefore still be filed from January 1, 2023 on.
EPO NEWS: EPO SETS START OF TRANSITIONAL MEASURES TO 1 JANUARY 2023
Aligning with the recently published implementation roadmap published by the Unified Patent Court (UPC), the EPO has decided to adjust the starting date of its transitional measures for filing early requests for unitary effect and filing requests for a delay in issuing the decision to grant a European patent to 1 January 2023.
The measures are applicable until the entry into operation of the Unitary Patent Protection system which is expected to be on 1 April 2023.

UNIFIED PATENT COURT JUDICIAL APPOINTMENTS AND PRESIDIUM ELECTIONS
The UPC website has now published the list of 85 appointed judges and the composition of the Presidium. Mr Klaus Grabinski (DE) will become President of the Court of Appeal and Ms Florence Butin (FR) will be President of the Court of First Instance.
LATEST STATE OF PLAY IN VIEW OF THE LAUNCH OF THE UNIFIED PATENT COURT (UPC)
The UPC shared the implementation roadmap. This roadmap depicts all the key activities and milestones of the UPC in the coming months.
The entry into force of the UPC Agreement is currently planned for 1 April 2023, with the UPC opening its doors and starting to receive cases as from that date.
